Terms and Conditions of Sale

1. Parties and Scope

These General Terms and Conditions of Sale (the “Terms”) govern the purchase of artisanal food products sold on the website
shop-albanesigroup.ch (the “Site”), operated by VBS Food GmbH, registered office at
Rigiweg 21a, 6343 Holzhausern (ZG), Switzerland, VAT/UID: (enter UID if desired),

+41 (0) 44 272 30 30 (the “Seller”).

The Site sells to end consumers and professional customers in Switzerland, the European Union, and the EEA. By placing an order, you fully accept these Terms.

Bahnhofplatz 12, 8001 Zürich, Switzerland.

2. Product Features

The products are artisanal panettoni and packaged baked goods, made and packed in Switzerland in compliance with applicable hygiene regulations (HACCP/OSAl).
Images on the Site are illustrative; minor differences due to artisanal processing are not defects.

Each package lists ingredients, allergens, lot number, best-before date and storage instructions.

3. Prices, Currencies, and Taxes

• Prices are in Swiss francs (CHF). Any EUR equivalent shown is indicative.
• Prices in Switzerland include Swiss VAT where applicable. For shipments to the EU/EEA, any import VAT, duties, or customs fees are paid by the Customer and collected by the carrier/local authorities.
• The order total including shipping is shown before order confirmation.

4. Payment Methods

We accept: credit/debit cards (Visa, Mastercard, American Express), PayPal,
advance bank transfer (where available), and other electronic methods at checkout (e.g., Apple Pay, TWINT if enabled).
Payments are processed via certified gateways; the Seller does not store card data.

5. Contract Formation

1. The order sent by the Customer is a purchase offer.
2. The contract is concluded when the Seller sends the order confirmation by email or when shipping starts.
3. The Seller may refuse orders that are non-compliant, suspicious, or in case of product unavailability/obvious pricing error.

6. Shipping, Delivery, and Risk

• Dispatch from: Switzerland. Carriers: Swiss Post, DHL, UPS or equivalents.
• Estimated times: Switzerland 1–3 business days; Europe 3–7 business days.
• Tracking is emailed when your order ships.
• Delays due to customs, natural events, strikes, or seasonal peaks do not entitle you to compensation.
• The risk of loss/damage passes to the Customer upon delivery of the parcel.

7. Right of Withdrawal and Returns (food products)

For hygiene and food safety reasons, the right of withdrawal does not apply to packaged food goods that have been opened or whose seal has been tampered with after delivery. Without prejudice to mandatory rules in the EU consumer’s country, returns are in any case excluded for perishable food products.

Exceptions (return/termination): we accept claims for products damaged on delivery or not as described in the order. The Customer must send a notice to
shop@shop-albanesigroup.ch within 48 hours of delivery,
attaching clear photos of the outer box, shipping label, contents, and the defects found.
If the claim is valid, we will arrange a replacement or refund.

8. Conformity Warranty

The Seller warrants that products match their description at the time of shipping. Minor differences due to artisanal manufacturing are not defects.
Proper storage (cool, dry place, away from heat/moisture) is the Customer’s responsibility and a condition for any warranty.

9. Customs and Imports (EU/EEA)

• Shipments to the EU/EEA may be subject to inspections and customs charges.
• Import VAT and duties are paid by the Customer and collected by the carrier/local authorities.
• The Seller is not liable for delays/holds caused by customs authorities.

10. Limitation of Liability

Except in cases of willful misconduct or gross negligence, the Seller’s liability is limited to the value of the product in the order. Indirect damages or loss of profit are not compensable.

11. Personal Data Protection

Personal data are processed in accordance with the FADP (Switzerland) and, for EU Customers, the GDPR.
Purpose: order, payment, and shipping management, support, and legitimate commercial communications.

12. Intellectual Property

Trademarks, logos, texts, images, and packaging on the Site are owned by the Seller or used under license. Any unauthorized use is prohibited.

13. Governing Law and Jurisdiction

• These Terms are governed by Swiss law.
• For any dispute, the Courts of the Canton of Zug (ZG), Switzerland have exclusive jurisdiction.
• For EU consumers, the mandatory consumer protection rules of their country of residence apply where provided.
